The use of wireless communication devices is prohibited within any room where voting is taking place. In addition, mechanical or electronic devices capable of recording sound or images are prohibited within 100 feet of a voting station.
Prohibited devices include, but are not limited to:
- Recording Devices (sound or videos)
- Cell Phones
- Cameras
- Tablet computers
- Laptop computers
- Any device that may communicate wirelessly or be used to record sound or images.
The presiding judge has the discretion to determine whether a wireless communication device is being used to record sound or images, and may require individuals to deactivate such devices or direct anyone who does not comply to leave the polling place.
Exceptions
- Election officials, such as the Presiding or Alternate Judge, can use electronic devices for official duties.
- Voters with special needs may be granted permission to use electronic devices to aid their voting process at the Election Judge’s discretion. Tex. Elec. Code §§ 61.014(a), 81.002.
